These terms govern your use of Eupheme, a service operated by Eupheme LLC ("Eupheme," "we," "us"). By creating an account, you agree to these terms.
Eupheme is intended for individual professional use by adults 18 and older, evaluating your own communication in meetings you participate in.
Eupheme analyzes meetings you select for the purpose of providing you with feedback on your own communication. Reports are generated using AI analysis and reviewed by a human before delivery.
When you select a meeting for analysis, Eupheme provides an in-meeting notice to all participants informing them that the meeting is being recorded and that your communication specifically is being analyzed. You are responsible for complying with any additional notice or consent requirements that apply in your jurisdiction or the jurisdiction of other participants, including two-party or all-party consent laws where applicable. Eupheme's built-in notice mechanism is designed to assist with this, but does not by itself guarantee compliance with every applicable law.
Eupheme is a personal coaching tool, not a workplace surveillance or human resources tool. You agree not to use Eupheme:
Eupheme operates on a subscription and credit system, as described on our pricing page. Credits reset monthly and do not roll over. Subscriptions may be canceled at any time; access continues through the end of the current billing period.
Reports generated for you are yours. We do not share, sell, or grant any other party, including any organization that may sponsor your subscription, access to the contents of your individual reports.
Eupheme provides communication feedback generated in part by AI. It is not a substitute for professional coaching, therapy, legal, or human resources advice, and should not be relied upon as such.
Eupheme is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, Eupheme LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall Eupheme LLC, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to your use of or inability to use the service.
Our total aggregate liability for any claims arising under these terms or your use of the service shall not exceed the total amount paid by you to Eupheme LLC in the twelve (12) months preceding the event giving rise to liability.
You agree to defend, indemnify, and hold harmless Eupheme LLC and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the service; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third-party right, including without limitation any right of privacy, publicity, or intellectual property; or (iv) your failure to secure legally sufficient notice and consent from meeting participants as required by applicable local, state, national, or international laws.
We may suspend or terminate access for violation of these terms, including use of the service in a way inconsistent with the acceptable use section above.
These terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. You and Eupheme LLC agree that any legal action or proceeding arising out of or relating to these terms shall be brought exclusively in the state or federal courts located in Wilmington, Delaware, and both parties hereby submit to the personal jurisdiction and venue of those courts.
We may update these terms from time to time. Material changes will be noted with an updated date above.
